CONTRACT & HEALTH WARRANTY
This agreement is between (Sellers) Darby and Wendy Sanders and:

It is agreed between Seller and Buyer as follows:

2. CONDITIONS OF SALE
Health Guarantee
Bengalskaya Cattery guarantees your kitten to be free from infectious diseases for 4 days after kitten leaves our premises, and guarantees kittens to be free from genetic problems for one year. Some conditions apply, as stated below. Kitten will leave our facility clean, in good general health, and with no physical defects. The kitten will be examined by a veterinarian prior to leaving our cattery.

Dewormings and immunizations set forth by our veterinarian will have been completed. While it is generally recognized that intestinal parasites and ear mites are common in kittens, and part of a kitten’s early development, we will make every effort to prevent such parasites. Often, the stress of change and travel can cause intestinal parasites to emerge after the kitten has left its mother. Buyer agrees to continue de-parasitization testing and treatment (if necessary) with their veterinarian. |

New owners must take their kitten to their veterinarian within 1 week of receiving kitten for examination, testing for worms, treatment for worms if necessary, and to schedule ongoing immunizations. Failure to have the kitten examined by vet within four days of date kitten was received by buyer, or if purchaser fails to provide required immunizations or dewormings, will void the health guarantee. Proof must be submitted to Seller that kitten has been examined within the time specified. |

If the purchaser’s veterinarian finds the kitten to be in poor health, the |
veterinarian’s written description of the problems must be provided, dated within
4 days of the date purchaser received their kitten.

With documentation by vet that is dated within 4 days of receipt of kitten that shows infectious illness |
or genetic defect, purchaser will be refunded price of kitten or given a replacement kitten. Transportation
costs will not be refunded and are not included in this guarantee. Cost of exams and tests are responsibility
of buyer.

Purchaser agrees to spay or neuter the kitten at or before 6 months of age. Purchaser agrees that this kitten is sold |
strictly as a pet and will not be used for breeding. Buyer agrees to send proof of spay or neutering to the sellers.

Genetic defects of the blood, specifically Feline Leukemia Virus and Feline Immunodeficiency Virus are covered by this guarantee for one year. A warranty for genetic defects such as heart and spinal problems is provided for one year after the date of the sale of your kitten. A written examination from an independent veterinarian must state that genetic defect exists and be accompanied testing as appropriate. Buyer must contact seller for consultation, PRIOR to treatments for genetic defects, to review all possible treatments. With documentation by vet that shows genetic defect, purchaser will be refunded the price of kitten, given a replacement kitten or will receive a refund up to the purchase price for treatment. Transportation costs will not be refunded and are not included in this guarantee. |

Buyer must keep growing kitten at a healthy weight appropriate for its size; and must feed their kitten a nutritious and quality brand of cat food. |

Buyer agrees to maintain this Cat in good health and will provide routine |
preventative healthcare. Regular vaccinations, parasite control and preventative
medications will be administered as set forth by a Licensed Veterinarian.
Veterinarian records will be required in the event of requesting a replacement
Cat or a refund. If routine healthcare has not been provided, this contract will be
null and void.

Buyer must sign and agree to Spay/Neuter Contract below. Failure to comply with this agreement will be considered a breach of the Contract, will void the Health Guarantee and may result in litigation where the SELLER may sue for damages. Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the buyer. |
3. SPAY NEUTER CONTRACT
Permanent ownership of this Cat is contingent upon your compliance with this
Addendum. Proof of the spay/neuter must be received by the PURCHASER within 6 months after receiving your kitten. In the event that surgery is not done,
Bengalskaya Cattery must be provided with a statement from your veterinarian that this Cat is not yet in physical or emotional condition for surgery. Based upon the veterinarian’s evaluation of this Cat the (PURCHASER) will contact the veterinarian and establish the earliest date that the procedure can be performed. (PURCHASER) will notify the BREEDER of this amendment in writing, at which time all other conditions of this agreement will apply and be enforced.
It is the responsibility of the PURCHASER, not the veterinarian, to ensure that
Bengalskaya Cattery has received verification that the surgery has been performed. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of the Contract. Failure to comply with this agreement will void the Health Guarantee and may result in litigation where the SELLER may sue for damages.
By my signature below, I agree to have this Cat spayed/neutered by no later
than__________________________, and I understand that this spay/neuter agreement is an agreement that this Cat will not produce a litter of kittens either as purposely bred or by accidental breeding. I also agree that failure to comply with this agreement will void the Health Guarantee.

4. FULL AND FINAL AGREEMENT
The parties agree that this writing represents the entire Agreement between them and that
no other representations have been made regarding the Cat described above.
Agreement must be signed and RETURNED by _____ / _____ / ________,
or warranty is void and breeder is released from all contractual obligations.
